Climate Change and Sustainability Practice

Climate change is perhaps the most dynamic component of environmental law in today’s world.

Businesses seeking to stay in compliance and maintain their competiveness need to be aware of the rapidly evolving body of controls affecting their daily operations. Moreover, the climate change policies of today are shaping the technologies and markets of tomorrow providing a window of great opportunity for those positioned to capitalize on them.

Our attorneys have an in-depth understanding of the climate change debate and the emerging legal regimes being considered and implemented at the international, national, regional and local levels. We participated in the first-in-the-nation auction of carbon dioxide emissions allowances in the market-based, cap and trade program known as the Regional Greenhouse Gas Initiative (RGGI). Additionally, we have represented clients before international bodies such as the 20th Meeting of the Parties to the Montreal Protocol in Doha, Qatar and are working closely with local legislators to help shape emerging national policies.

We are prepared to assist and provide counsel on all aspects of climate change including:

  • Compliance with regulatory requirements, permits and licenses
  • Defense of government and/or private enforcement actions, responding to regulatory rulemaking and compliance litigation
  • Enforcement of climate change legislation and policies
  • Sale and purchase of GHG credits/offsets
  • Renewable energy projects
  • Business transactions, regulation and policy making related to climate change
  • Climate change related due diligence
  • Development of substitutes for ozone depleting substances (“ODSs”)
  • Destruction of ODSs in discarded stockpiles, equipment and products (collectively referred to as “Banks”)
  • Formation of climate change policies and project development in areas of carbon transactions, renewable energy and GHG reform
  • LEEDs building certification and other industry specific “Green” certifications
